Welcome to Colobo Club. These Terms & Conditions govern your access to and use of the clubcolobo.in website, mobile applications, and multi-vendor hotel booking services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
1. Role of the Platform
Colobo Club India Pvt. Ltd. operates as an online marketplace and technology intermediary. We facilitate the booking of hotel rooms and accommodations by connecting users ("Customers" or "Guests") with independent property owners, managers, and operators ("Vendors").
We do not own, operate, or manage the accommodations listed on the Platform.
The actual contract for the provision of accommodation is directly between the Customer and the Vendor.
2. Customer Responsibilities & Bookings
Account Registration: You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials.
Identification: Guests must present valid, government-issued photo identification at the time of check-in. The Vendor reserves the right to deny entry if valid ID is not provided, and no refunds will be issued by Colobo Club in such instances.
Payments & Wallets: Bookings may be completed via online payment gateways or utilizing the "Pay at Hotel" option. Virtual Membership Wallet balances or discount points hold no cash value, are non-transferable, and may only be applied toward eligible bookings on the Platform as per promotional guidelines.
Cancellations & Refunds: Cancellation policies are set by the respective Vendors and displayed on the property listing page prior to checkout. Colobo Club processes refunds for online payments strictly according to the specific Vendor's cancellation policy.
3. Vendor Responsibilities
Inventory & Accuracy: Vendors are strictly responsible for maintaining accurate room availability, pricing, and property descriptions (including real images) on their Vendor Dashboard.
Honoring Bookings: Vendors must honor all confirmed bookings generated through the Platform. If a Vendor fails to provide the booked accommodation (e.g., due to overbooking), the Vendor is responsible for arranging alternate, comparable accommodation for the Customer or fully refunding the amount, subject to platform penalties.
Commissions: Vendors agree to the commission structure (either flat-rate or percentage-based) as configured by the Colobo Club Admin. Commissions will be automatically deducted from the total booking value prior to vendor payouts or billed periodically for "Pay at Hotel" bookings.
4. Limitation of Liability
To the maximum extent permitted by law, Colobo Club India Pvt. Ltd. shall not be liable for:
Any injury, loss, claim, or any direct, indirect, incidental, or consequential damages arising from your stay at a Vendor's property.
Any discrepancies between the property images/descriptions on the Platform and the actual condition of the property.
Service interruptions, technical errors, or unauthorized access to our servers.
5. User Conduct
Users agree not to:
Use the Platform for any fraudulent or speculative bookings.
Upload any malicious code, viruses, or inappropriate content (including explicit images) to the Platform.
Attempt to bypass the Platform to contact Vendors directly for the purpose of avoiding commission fees.
6. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Rajkot, Gujarat.
7. Modifications
Colobo Club India Pvt. Ltd. reserves the right to modify these Terms & Conditions at any time without prior notice. Continued use of the Platform following any changes constitutes acceptance of the new Terms.
